April 7, 2006 — The U.S. International Trade Commission (ITC) will uphold existing antidumping orders on small diameter carbon and alloy seamless standard, line and pressure pipe imported from Japan and Romania, and for large diameter carbon and alloy seamless standard, line, and pressure pipe from Japan. However, existing orders for similar products from the Czech Republic and South Africa (small diameter) and Mexico (large diameter) will be revoked.
| The Uruguay Round Agreements Act requires the Department of Commerce to revoke an antidumping or countervailing duty order, or terminate a suspension agreement, after five years unless the Department of Commerce and the ITC determine that revoking the order or terminating the suspension agreement would be likely to lead to continuation or recurrence of dumping or subsidies (Commerce) and of material injury (ITC) within a reasonably foreseeable time. |

The ITC’s decisions follow five-year (sunset) reviews regarding all products in question. As part of the review process, the Commission determined that revoking the existing antidumping duty orders would be likely to lead to material injury for small diameter pipe from Japan and Romania, and large diameter pipe from Japan. The Commission also determined that revoking the existing antidumping duty orders would not be likely to lead to material injury for small diameter pipe from the Czech Republic and South Africa and large diameter pipe from Mexico.

Pearson voted in the negative with respect to small diameter carbon and alloy seamless standard, line, and pressure pipe from the Czech Republic, Romania and South Africa and large diameter carbon and alloy seamless standard, line, and pressure pipe from Mexico; they voted in the affirmative with respect to small and large diameter carbon and alloy seamless standard, line, and pressure pipe from Japan.
Commissioner Shara L. Aranoff voted in the affirmative with respect to small diameter carbon and alloy seamless standard, line, and pressure pipe from Japan and Romania and large diameter carbon and alloy seamless standard, line, and pressure pipe from Japan; she voted in the negative with respect to small diameter carbon and alloy seamless standard, line, and pressure pipe from the Czech Republic and South Africa and large diameter carbon and alloy seamless standard, line, and pressure pipe from Mexico.
Chairman Stephen Koplan and Commissioner Charlotte R. Lane voted in the affirmative with respect to small diameter carbon and alloy seamless standard, line, and pressure pipe from the Czech Republic, Japan, Romania, and South Africa and large diameter carbon and alloy seamless standard, line, and pressure pipe from Japan and Mexico.
The five-year (sunset) reviews concerning Carbon and Alloy Seamless Standard, Line, and Pressure Pipe from the Czech Republic, Japan, Mexico, Romania, and South Africa were instituted on May 2, 2005. On August 5, 2005, the Commission voted to conduct full reviews.
