By definition, Dumping occurs when a foreign company sells a product in the United States at less than fair value.

Commerce determined that Turkish producers/exporters have sold rectangular pipe in the United States at margins between 27.04 and 41.71% less than fair value. Commerce assigned the rate of 41.71% to Guven Boru Profil Sanayii ve Ticaret Limited Sirketi and MMZ Onur Boru Profil Uretim San. ve Tic. AS, as well as other non-responding producers; the rate is based on adverse facts available because these respondents failed to fully cooperate.
As a result of this final determination, Commerce will instruct U.S. Customs and Border Protection to collect a cash deposit or bond on entries of rectangular pipe from Turkey from all producers/exporters based on the final rates.
The U.S. International Trade Commission (ITC) is scheduled to make its final injury determination on or about May 22, 2008. If the ITC finds real or threatened material injury to the domestic industry associated with imports of rectangular pipe from Turkey, Commerce will issue an antidumping duty order.

The investigations covered welded carbon-quality light-walled steel pipe and tube with a rectangular cross section and a wall thickness of less than 4 mm. Carbon quality steel includes both carbon steel and alloy steel (which contains only small amounts of alloying elements). Rectangular pipe can be used for fencing, window guards, and railing for the construction industry, but it is not used for conveying liquid or gas.
